1. Introduction

Welcome to NikkoBites. By accessing or using our services through our mobile applications or website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.

NikkoBites operates as a food delivery aggregator under applicable Indian laws, including the Food Safety and Standards Act, 2006.

2. Definitions

  • "Platform" refers to the NikkoBites mobile applications and website.

  • "User" refers to any individual or entity using our Platform.

  • "Restaurant Partner" refers to restaurants listed on our Platform, each of which is required to hold a valid FSSAI license/registration.

  • "Delivery Partner" refers to individuals or entities facilitating the delivery of orders.

3. Eligibility

Users must be at least 18 years old to use our services. By using the Platform, you represent and warrant that you meet this requirement.

4. User Account

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

5. Orders and Payments

  • Orders placed through the Platform are subject to acceptance by the respective Restaurant Partner.

  • Prices listed are provided by Restaurant Partners and may be subject to change.

  • Payment can be made through various methods provided on the Platform.

  • In case of payment failures, orders may be canceled at our discretion.

6. Delivery

  • Delivery times are estimates and may vary due to factors beyond our control.

  • With NikkoBites, your favorite meals are delivered fresh and hot right to your doorstep within 1–2 hours. Fast, reliable, and made for Port Blair!

  • Users are responsible for providing accurate delivery information.

  • If a delivery cannot be completed due to incorrect information or unavailability, the order may be canceled without a refund.

7. Cancellations and Refunds

  • Cancellation policies vary by Restaurant Partner.

  • Refunds, if applicable, will be processed according to our refund policy and may take several business days.

8. Wallet Terms

The NikkoBites Wallet allows users to add funds using secure online payment gateways and use those credits to pay for food orders within the app. Wallet balance may also include promotional credits, referral bonuses, or refunds. Funds added to the wallet are non-withdrawable and can only be used for in-app purchases. The Company reserves the right to adjust or revoke wallet credits in case of refunds, cancellations, or misuse.

9. Loyalty Points Terms

Users may earn loyalty points on eligible orders placed through the NikkoBites app. These points have no cash value and cannot be transferred or withdrawn. Points can only be redeemed as wallet credits and used for food orders within the app. The Loyalty Program is offered as a promotional feature and may be changed, suspended, or discontinued at any time without prior notice.

10. User Conduct

Users agree not to:

  • Use the Platform for unlawful purposes.

  • Interfere with the operation of the Platform.

  • Post or transmit harmful, misleading, or offensive content.

11. Compliance with Food Safety Laws

  • All Restaurant Partners are required to maintain valid FSSAI registration/license and comply with the Food Safety and Standards Act, 2006.

  • NikkoBites may delist any Restaurant Partner found to be in violation of applicable food safety regulations.

12. Intellectual Property

All content on the Platform, including logos, text, and graphics, is the property of NikkoBites or its licensors and is protected by applicable laws.

13. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

14. Limitation of Liability

NikkoBites shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Platform or services.

15. Indemnification

Users agree to indemnify and hold harmless NikkoBites, its proprietor, affiliates, and partners from any claims arising out of their use of the Platform.

16. Modifications

We reserve the right to modify these Terms and Conditions at any time. Continued use of the Platform constitutes acceptance of the revised terms.

17. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Port Blair, Andaman and Nicobar Islands.
